Texas injury law, in plain numbers

The rules that decide most car-accident claims in Texas. Each one cites the statute so you can check it yourself.

2 years
to file a personal injury lawsuit

The clock starts on the date of the crash. Miss it and the claim is gone, no matter how strong it was.

Tex. Civ. Prac. & Rem. Code §16.003
51%
the fault line that ends a claim

You can recover if you were partly at fault, as long as you were not more than 50% responsible. Your recovery is reduced by your share.

Tex. Civ. Prac. & Rem. Code §33.001
30 / 60 / 25
minimum liability coverage, in thousands

$30,000 per injured person, $60,000 per crash, $25,000 property damage. Many drivers carry only this, which is why your own UM/UIM coverage matters.

Tex. Transp. Code §601.072
$2,500
PIP your insurer must offer you

Personal injury protection pays your medical bills and lost wages regardless of fault. It’s on your policy unless you rejected it in writing.

Tex. Ins. Code §1952.152
$0
to find out whether you have a case

The consultation is free. If you hire us, the fee is agreed in writing before any work begins.

Our fee agreement
1 call
before you give a recorded statement

You are not required to give the other driver’s insurer a recorded statement. Talk to a lawyer first. It’s free.

A fair question

Already asked ChatGPT about your accident? Good.

It probably told you the two-year deadline, the 51% rule, and not to give a recorded statement. That’s all correct. Here’s what it can’t do, and what it may have gotten wrong about your case.

Ask Abraham Instead. It’s Free.
It can’t read the crash report, the policy, or your medical records. It only knows what you typed. The case lives in the documents.
It can’t call the adjuster, send a demand, or file suit. Knowing the rule is not the same as making the insurer follow it.
What you tell it isn’t privileged. What you tell a lawyer is.
It doesn’t know your case. It knows the general rule. Whether that rule helps you depends on facts it has never seen.

Frequently asked questions

Short answers first. The details follow. Answered by Attorney Abraham Peña.

Do I need a lawyer for a minor car accident in Texas?

Not always, but find out before you sign anything. If nobody was hurt and the damage is only to the car, you can often handle it. If you felt any pain, saw a doctor, or the insurer is asking for a recorded statement, call first. The consultation is free, and “minor” injuries are often the ones insurers undervalue.

How much does a personal injury lawyer cost in Texas?

Nothing to find out. The consultation is free. If you hire us, the fee is agreed in writing before any work begins, so there are no surprises later.

Should I give the other driver’s insurance a recorded statement?

No. Not before talking to a lawyer. You are not required to. The adjuster works for the insurer, and the statement is taken to find reasons to pay less.

Can I still recover if the accident was partly my fault?

Yes, if you were 50% or less at fault. Texas uses modified comparative fault: your recovery is reduced by your percentage of blame, and barred entirely at 51% or more. Insurers push your number up. We push back.

How long do I have to file a claim in Texas?

Two years from the date of the crash to file a lawsuit for personal injury (Tex. Civ. Prac. & Rem. Code §16.003). Claims against a city, county, or state agency have much shorter notice deadlines, sometimes only months.

Does Attorney Peña speak Spanish?

Sí. Abraham is bilingual and handles your case in English or Spanish, from the first call to the last signature. Not a translator. The lawyer.

What if the driver who hit me has no insurance?

Check your own policy for UM/UIM coverage. Uninsured/underinsured motorist coverage pays when the other driver can’t. Texas insurers must offer it; many people have it without knowing.

Where does Attorney Peña take cases?

All of Texas. The office is in McAllen, in the Rio Grande Valley, and we represent injured people statewide. Consultations by phone or video.
